Any misleading or untrue declaratio15、n given by you may lead to punishment or even dismissal(2)入職時填報的以下個人資料如有變更,必須在變更后七日內以書面形式知會人力資源部更新。如因員工未及時通知而導致的任何延誤,一切責任由員工自負。Should any following information change, within 7 days you are to inform the HR & Admin Dept .on the appropriate from, any cost caused by delay shall be charged to the emplo16、yee.(a)名 字 的 更 改 Change of name.(b)身份證號碼的改變 Change of ID card number(c)聯系地址、電話號碼的改變 Change of your contact address or telephone number(d)緊急事件聯系人姓名和電話號碼的更改 Change of the name & phone number of your emergency contact person(e)獲得其它教育專業資格New certification Obtained from further education(f)個人技能的獲得如駕車、急救等17、Acquired personal skill, such as driving license, first aid.etc.,(g)工資銀行卡號碼的更改Change of the payroll account合適的支持文件,同樣應該上交。Relative supporting documents shall also be provided.五、試用與轉正Probation Period and Confirmation51試用期限Probation Period員工試用期一般為兩個月,視工作表現和情況需要可縮短或延長,但不應少于一個月或超過六個月。試用期間,部門主管將員工的工作表現進行18、評估。Except in special case, all new employees will have a probation period. not exceeding 6 6 months During the probation period, an appropriate performance evaluation shall be conduct by your department head.如在試用期內表現符合公司要求,試用期屆滿時將獲正式的書面通知書。If your performance during the probation period meets the co19、mpany requirement during the probation period, the employees shall receive a formal confirmation letter from the company on the probation expiration. 所有合約員工在試用期內,品行欠佳、工作態度不良、對公司有不滿情緒、非因工而患有重疾病或傳染病者,公司有權對其即時辭退;員工如在試用期內發現不適應公司得工作環境和條件,也有辭退離開公司得權利。 對于不能通過試用期考核或表現未通過公司要求者,公司有權終止勞動合同,解除勞動關系。If your perfo20、rmance during the probation period can not meet the requirement of the company, then the company may require to extent your probation or terminate the employment offer with you, a formal written notice will be issued to you.52轉正程序新員工試用期屆滿前15天,由人事行政部向用人部門發出員工轉正表和試用人員轉正考評表。部門負責人收到員工轉正表后,先發放到員工手上讓員工進行自21、我總結后再交由部門負責人連同試用人員轉正考評表一起對員工進行考評,填寫轉正意見,交到人事行政部。如在此期間因員工本人或部門負責人因延遲交表而造成一切后果由當事人負責。人事行政經理收到審批意見后,正式辦理員工轉正或辭退事宜。53轉正或辭退手續辦理 如同意該員工轉正,則按要求辦理轉正手續; 需延長試用期的,則由人事行政部向該員工發出延長試用期通知書; 需辭退的,則辦理辭退手續;從辭退之日起,被辭退人員與本公司的勞動關系自動終止,本公司停止為其辦理社會保險事宜。 員工經審批被正式錄用的,由人事行政部通知員工本人以示確認,同時員工入職時簽訂的勞動合同正式生效。六、晉升、降職、調崗、調薪 Promote22、, Demote, Position moved, Salary adjustment公司將根據員工的工作績效、崗位能力素質要求及崗位空缺情況給對員工崗位、工資及職務做出相應的調整。The company shall be adjust your position and salary upon fall assessment of your skills, ability and performance 因工作需要,員工轉換崗位按以下程度:61普通員工的轉職/升職,由部門負責人填好職位變動申請表里的轉職/升職理由,員工工作表現及相關技能說明,報人事行政部審核后發出部門調動通知書到員工本人6223、管理級別員工的轉職/升職,需要人事行政經理對其員工的工作表現及所能達到的技能水平評估后由經理審批63員工轉換或提升到新職位通過兩個月試用期后,其主管需作表現評估,以決定該員工是否適合新職位,若評估結果表明不符合職位要求,需重新作崗位調動。七、解除勞動合同 Contract Termination71在勞動合同期內,公司可對下列員工解除合同,具體手續按有關管理規定辦理。During the employment period, the company shall terminate your employment,according to relevant procedure of the re24、lative management regulation.(1) 表現欠佳,經警告、培訓、調整崗位仍不能勝任工作的;You employee can not work well, even after warning & training have been given.(2) 員工患病或非因工負傷,醫療期滿后不能從事原工作的;You employee contracts a disease or become wounded and after a statutory medical treatment period still can not perform your original r25、ole(3) 因客觀原因導致原合同無法履行,經協商未達成一致的。The contract can not be execute for objective reasons, and cannot reach an agreement after negotiation72公司員工有下列情形之一,經查證屬實者,立即給予解雇,并不付任何經濟補償。1)對領導給予的批評、教育采取謾罵、人身攻擊或有威脅、毆打行為者,從而擾亂了生產、工作和生活秩序2)在公司內外有意怠工,不服從上司的合理工作安排,無理取鬧、聚眾鬧事、打架斗毆、影響生產秩序、工作秩序者。打人致傷者必須負擔受傷者一切費用和損失,如用利器打架的26、報公安機關3)玩忽職守,違反技術操作規程和安全規定,或違章指揮,造成事故,使人身財產遭受較大損失者4)造謠生事,散播謠言,煽動鬧事,謊報案情、災情,制造混亂,造成嚴重后果者;5)組織、煽動怠工,或采取不正當手段要挾領導,嚴懲擾亂公司秩序者6)利用公司名義在外招搖撞騙,以致公司名譽蒙受重大損失者。7)蓄意損壞公司或他人財物,故意泄漏技術、營業之秘密,致使公司蒙受損害者。8)對上級或同事實施暴行或有重大侮辱之行為者9)違反勞動合同或工作規則情節嚴重或經常違反公司規定屢教不改者10)擅離職守,導致事故,使公司蒙受重大損失者11)泄漏生產或業務上機密者12)在工作中酗酒滋事妨害生產秩序者13)依合同約27、定調派工作,無故拒絕接受者14)因行為不當,公司無法再對其信任者15)在廠內有傷風化行為者16)偽造資料(如假生產記錄,假簽名)或擅自變更工作方法或提供虛假個人資料、證明文件、學歷、介紹信、虛報人事記錄,使本公司誤信而遭受損害者17)其他重大過失或不當行為,導致嚴重后果者18)私拆設備、產品,盜竊公、私財物價值500元以上者(駕駛員為其提供方便的按盜竊論);19)詐騙公、私財物500元以上的者;20)因工作失職造成公司損失達5000元以上者21)對來賓言語或行為輕浮不當或粗暴無禮者22)對來賓索取好處及貪小便宜或故意刁難者23)代替他人打卡或接受他人代打卡者24)在一個月內連續曠工三天或累計曠28、工三天以上(含三天)者25)賭博或為賭博提供條件者26)在禁煙區內吸煙或引火者。27)私取或偽造公章、證明、證件以及未辦手續私自刻制公章者;28)違反國家槍支、刀具管理規定,非法制造、販賣、攜帶槍支或匕首、三棱刀、彈簧刀等管制品者;29)任何觸犯中華人民共和國刑法的行為者。73 員工及公司均可按指定通知期或通知金代替通知期而終止勞動合同工作期通知期通知金代通知期試用期內7日通知期以聘用書中員工的日薪為基準。乘以所欠通知期天數作為代通知金。試用期后1個月通知期以解除勞動合同前1個月,員工的日新為基數,乘以所欠通知天數作為代通知金。凡自愿辭職的員工,必須按規定提前填寫員工離職申請表經部門主管和人事29、行政部批準后方可離職。員工辭退/辭職均需在辦理離職手續時填寫離職交接清單,員工離職前應將公司交付使用或保管的物品、工具、公司資料等交還給公司,并按照與公司所簽訂的協議承擔應盡義務。注:1) 正式員工應于一個月前提出書面申請,試用期員工則需提前一周提出書面申請;2) 試用期間如工作日不滿七天。請辭者將不予以工資結算;3) 如正式員工在勞動合同的服務年限期間離職的,應按合同規定的違約金金額進行賠償。 八、工作移交 Working Handover員工在離職前應辦妥離職手續,包括財務清理帳目,移交工作、交還相關工作文件,磁盤、工具、名片、工作證等方可獲工資結算及離開公司。 Final payment30、 and leaving shall not be permitted until you have handed over all related works, including financial settlement, working handover, returned relative documents, disks, tools, business name card, name tag etc. 第三章 員工薪酬制度Chapter 3 Salary System一、薪酬結構Structure of salary 公司根據級別架構支付工資,各個不同級別都有不同的工資標準,薪酬由31、基本工資及津貼構成。The company pays a salary according to its payroll structure; there are different levels to different grades. The salary is consists of a basic salary and allowances.公司將根據員工的教育、技術水平、經驗,工作責任等決定工資。 The salary will be set according to your education degree, technical skills, working experienc32、e and working duty, etc.保險包括養老保險、醫療保險、失業保險、生育保險、工傷保險等。 The insurance includes pension, medical, unemployment, birth control, working injury etc.員工必須按國家規定自行負擔個人所得稅及社會保險中的個人繳費部分,并由公司在工資中予以代扣代繳。You employees shall be responsible for part of the individual tax and relative insurance expenses according t33、o statutory regulation; it will be deducted from your monthly salary.2. 發薪方式 Salary Payment 工資于每月的固定日期,由銀行轉帳存入員工銀行帳戶。Pay day shall be on one the fixed day of every month, the salary will be transferred by bank into your bank account.3. 薪酬保密Confidentiality of the salary 公司為員工的薪酬保密,員工應對自己的薪酬信息保密,不得泄露自34、己的薪酬信息,亦不得打聽和傳播他人的薪酬信息,如有違反,公司將對員工進行扣罰100元工資處理,嚴重者給予辭退處理。Both you and the company shall keep the salary information confidentially.You should not release your salary information to others, should not inquire or disseminate any salary information of other employees. Any violation will be subject to a35、 fine of RMB100.00 form your salary or dismissal for seriously violation.4工資調整 Salary adjustment公司將根據物價指數、同行業工資水平、公司生產經營情況及員工的工作表現等因素,原則上每年對員工工資級別和個人工資進行一年一調整。The company will review/adjust the salary once a year according to the market price index, salary level, the P&L of the company and youre wor36、king performance .5. 年終雙薪(第13個月薪金) Double pay ( 13th month salary )公司在營利情況下,員工于本公司服務滿一年(1月1日至12月31日),在中國農歷前一周享受當年雙薪。如果員工服務期滿3個月不足一年的,可按以月為單位按比例享受部分的年終雙薪。All employees with a continuous service for one whole year (From Jan. 1st to Dec 31st) . A yearly double pay will be issued according to the yearly37、 P&L performance of the company, payable one week before CNY. For employees who have worked for the company more than 3 months shall be entitled to double pay according the ratio of actual working month.6年終獎 Annual bonus 年終獎的發放根據公司該年度的實際經營情況,效益情況及員工的個人工作表現而定, 其金額及發放日期將由公司決定。. A yearly bonus will be 38、issued according to the yearly P&L performance of the company and the working performance of the employees, the amount and the issue day will be adjusted by company.第四章 工作時間與假期Chapter 4 Working Hours & Holidays一工作時間 Working hour1 1公司辦公室員工實行長短周工作制,長周工作五天半,短周工作五天。 The office working time of the compan39、y shall be a long/short week alternate, five and a half day for the long week, five days for the short week公司生產部員工實行七天工作制。 The production working time of the company shall be seven days a week1 2公司每天工作8小時。(不包括60分鐘的用餐休息時間)8 hours every working day (exclude 60 minutes lunch time)13工作時間與考勤: Normal work40、ing hour and attendance record:工作部門Work Department工作時間working hour上班Work start午餐休息時間Lunch time下班Work finish辦公室員工Officer8:30AM12:00PM-13:00PM17:30PM14工作時間調整 Working Hour Adjustment公司有權根據生產實際需要或意外情況對工作時間進行調整。The company is entitled to adjust the working hour according to actually production requiremen41、t or when unexpected accident happened.如:因政府部門供電不足而致在正常工作日不能生產,公司將相應安排員工在工作日調休,而在休息日或假日補上班。e.g. If electricity Supply Department stop power supply on workday, the company is titled arrange employees rest at workday, and compensate work on weekend or holiday.15加班 Over-time working151只有在絕對必須的情況下才可獲準加班42、。加班必須先獲部門主管書面批準。加班的時間必須在發生加班的當月考勤統計中結清。未經申請和事先批準的加班,公司不予承認。Overtime working will only be permitted when absolutely necessary. Working over time must be approved in writing by the Dept. head beforehand. The time for overtime working shall count in the current attendance record. Working overtime witho43、ut any approval shall be regarded as null and will not be compensated 152星期六或星期天加班安排作調休處理。調休的申請,在遞交申請表給行政人事部之前應得到部門主管的批準。Over time working on Saturday or Sunday shall be compensated by leave. Compensation leave application must be approved by the department head before submitting the form to HR & Ad44、ministration Department. 153辦公室人員及主任級以上管理人員加班作調休處理。Office staff and over supervisor level management over time working shall be compensated by leave.154對班后加班的員工,將安排補休或按政府有關規定發放加班工資。 Over time working after a day off shall be compensated by leave or by overtime payment according to the relative statu45、tory regulation.155公司有權根據運作效率和業務需要調整工作時間及休息日的安排。The company shall be entitle to adjust the working time according to the operational efficiency and business requirement156因生產制造或特殊崗位(如保安)之連續性,依實際所需擔任輪班。157加班工資按下列情況計算:工作日加班加班工時X小時工資率X150休息日加班加班工時X小時工資率X200法定日加班加班工時X小時工資率X300(日薪):小時工資率日基本工資/8(月薪):小時工資率46、月基本工資/22/8二、假期Holidays21年假Annual leaves一般員工進入公司過試用期后每年可享受有薪年假為6天(其中三天由公司安排于農歷春節統一休),每工作滿一年增加一天,最多不超過10天。Employees entitled to 6 days paid annual leave per year after probation period (3 days fix arranged on CNY), having worked for the company more than 1 year will be entitled to 1 day added for each47、 full year worked, up to a maximum annual leave of not more than 10 days in total主任級員工每年可享受有薪年假為8天,每工作滿一年增加一天,最多不超過12天。 Employees entitled to 8 days paid annual leave per year, having worked for the company more than 1 year will be entitled to 1 day added for each full year worked, up to a maximum a48、nnual leave of not more than 10 days in total經理級員工,每年可享受有薪年假為10天,每工作滿一年增加一天,最多不超過14天。Employees at manager level will be entitled to 10 days paid holiday per year, managers working for the company more than 1 year will be entitled to 1 day added for each full year worked, up to a maximum annual leave49、 of not more than 14 days total試用期視為服務年限的一部分,但試用期內不能申請年假。The probation period shall be count as the working period with the company, but employees under probation can not apply for annual leave.年假的申請,在遞交申請表給行政人事部之前應得到部門主管的批準。All annual leave application must be approved by the department head before50、 submitting the form to HR & Administration Department. 年假原則上不允許預支。 Taking annual leave in advance shall not be permitted.每年年假在12月31日后將不能累積,將會失效。沒有提前足夠時間申請,不能休年假。Annual leave not taken by the end of December will not accumulate and will expire.Annual leave may not be granted if insufficient notice i51、s given.休息1天 提前2天通知1 day leave: 2 days notice休息2 -3天 提前5天通知2-3 days leave: 5 days notice 休息4 -6天 提前2周通知4-6 days leave: 2 weeks notice休息7天以上 提前3周通知Over 7 days 3 weeks notice年假不能代替辭職的通知期,在辭職通知已經上交后,任何的年假申請就不會被考慮。在你離開公司時,公司將會以工資形式支付,你未享用的年假。Annual leave can not be taken as the notice period replacement52、. Annual leave application will not be considered after the resignation notice has been submitted. The outstanding annual leave will be paid with the final salary by Company.22法定休假 Holiday所有員工將有權享受每年8天的節假日,即:All employees shall be enjoy 8 days holidays in every year:元旦1天 New Year Day 1 day 1st of Ja53、n. 春節3天 Chinese New Year Day 3 days Lunar 1st3rd勞動節3天 Labor Day 1 day 1st of May國慶節3天 National Day 1 day 1st of Oct. 23婚假/喪假1)工作人員本人結婚或工作人員的直系親屬(父母、岳父母、公婆、配偶及子女)死亡時,給予一至三天婚喪假; 2)工作人員結婚時雙方不在一起工作的、以及工作人員在外地的直系親屬死亡時,可根據路程遠近,適當給予路程假;3)工作人員晚婚(男25周歲、女23周歲以上登記初婚的),除按規定享受婚假外,另增加婚假7天。夫妻雙方誰達到晚婚年齡誰享受。晚育的,男方護理假54、7天;4)工作人員在批準的婚、喪假期間,工資照發。往返途中的車船費等,由工作人員自理。23產假/哺乳假/流產假/看護假Maternity Leave/Lactation Leave/Misbirth Leave/Foster care Leave 1)產假假期,女職工產假為90天,其中產前休假15天,難產的增加產假15天。多胞胎生育的,每多生育一個嬰兒,增加產假15天;女職工懷孕不滿四個月流產的,應根據醫務部門的意見,給予15天的產假,懷孕滿四個月以上流產的,給予42天產假。 2)對晚育(指女24周歲生育第一胎的)并領取獨生子女證的,可在法定基礎上增加產假60天;難產的另增加產假15天。3)產55、假期間按出勤對待,工資照發,不影響評先進。4)晚育的男方有7天的護理假(包括節假日和公休日)5)有不滿一周歲嬰兒的女職工,其所在單位應當在每班勞動時間內給予兩次哺乳(含人工喂養時間),每次30分鐘。多胞胎生育的,每多哺乳一個嬰兒,每次哺乳時間增加30分鐘。女職工每班勞動時間內的兩次哺乳時間,可以合并使用。哺乳時間和在本單位內哺乳往返途中的時間,算作勞動時間。3.4 事假Personal leave事假適用于員工遇特殊事件而無剩余年假的情況下申請,公司不鼓勵員工申請此類假期,如有特殊理由或需要,應事先獲部門主管批準.事假為無薪假期。Personal leave shall be for empl56、oyee who meet special affair but fall short of annual leave, this kind of leave is not encouraged. Personal leave must get appropriate approval in advance by Dept. head. The company will assist in provide relative necessary training and sponsorship to meet your career target as well as to achieve the companys business goals.1. 資格Qualification for sponsorship 在公司服務年限滿一年,具有良好工作表現的正式員工For the permanent employee has a minimum of one y63、ear continuous service, and with a good working performance.申請的進修課程應與本職工作密切相關The course applied must be closely related with duties.培訓機構需經公司認可Training institution must be accepted by our company.時間應避免與日常工作相沖突Training time shall not conflict with daily working time.2.審批及資助程序Application and reimburse 64、procedure (1) 填寫申請表,提供課程內容大綱,學習時間安排及個人學習目的。Fill in the application form, present the course content, training schedule and the individual learning aim.(2) 部門經理、人力資源經理及總經理審批申請表,與員工簽訂培訓合同。Department manager,HR department manager and GM review and approval the application, sign training contract with t65、he employee.(3) 員工在繳費注冊后,向人力資源部提供有關申請表及單據備案后交財務部審核報銷50%費用。After paying the fee, shall submit employee provide the application form with bill to HR department for record, and then pass the bill to finance department to apply for 50% reimbursement.(4) 另外的50%將在完成課程培訓,向人力資源部提供學業合格證書后由財務報銷The remaining 566、0% fee will be reimburse by the Financial Dept. after the employee has successfully completed the training course and produced the training certificate to the HR department. (5)接受公司培訓資助的員工,如在合同服務期內離職的,將按培訓合同的規定對公司進行相應的違約賠償。Employee shall compensation the company by ratio if they leave the company wi67、thin the contract period.第六章 健康與安全Chapter 6 Health & Safety1. 公司將致力為公司提供一個健康及安全的工作環境。The company undertakes to provide a healthy and safety working environment for its employees.2 急救 Fist Aid車間及辦公室備有急救藥箱,為員工在必要時提供使用。First aid box shall be provided in workshop and office for the employees necessary u68、se.3 吸煙 Smoking 為保證生產安全,人事行政部將指定專門吸煙區,嚴禁在非吸煙區抽煙。違者每次罰款50元。In order to guarantee a safe and healthy production environment, HR & Admin Dept. shall appoint specific Smoking Zones in factory. Smoking in non-smoking zone is strictly prohibited. The violator shall be fined RMB50.00.for each offence4. 廠區衛69、生保潔Keeping factory tidy 為保持良好的工作環境,員工應自覺維護廠區保潔工作,嚴禁隨處亂丟垃圾,損壞公物等不良行為。違者視情節細重每次最低罰款20元。 For the purpose of maintaining a good working environment, employee should keep tidy around the factory, litter anywhere, damage public property is strictly prohibit. Such violation should be fined at least RMB20. 70、第七章 雇員的交流Chapter 7 Employees Communication1 通知和公告 Notices and circulars公司的新聞、通知、通告在通知板上貼上或發送電子郵箱。全體雇員可以定期收到相關資訊。 News about the company, notices and announcements are posted on the notice board or sent by E-mail. All employees can get relative information on a regular basis.2 部門會議 Departmental meeti71、ngs部門會議每月舉行一次加強成員之間的溝通,員工可就工作提出意見或建議。Departmental meetings should be held once every month to enhance communication between employees. Employees may ask questions or give comments related daily work with the Dept head. 3. 員工申訴Employees appeal 員工對其工作及公司各管理制度等不滿或不理解屬正常現象,公司提倡員工正常渠道反映,咨詢或申訴。Employee di72、scontentment or non-understanding about their job and the companys administration system is a natural phenomena, the company advocate the employees reflect, consultation or appeal by internal appropriate channel. 公司提倡員工用實名以書面的形式提出意見或建議,公司對員工的意見將采取公平及客觀的處理方式進行解決及回復。The company advocate employees advi73、ce the notions and suggests by the written form with true name, we will solve and reply employees opinion by fairness and objective way. 第八章 員工守則Chapter 8 Employees Rules1 儀表和著裝: Appearance and dress 員工著裝應整潔,得體,并符合相應職務、身份和場合。不得過于濃妝艷抹,也不得衣著過于新潮或暴露。The employees must dress neatly, decently, and manner74、 suitable for the job, status and occasions. 2 辦公安全及保安Office safely and security(1) 員工下班離開辦公室時,應鎖好辦公室抽屜,文件柜,關閉電腦等辦公設備。All the office staff must lock drawers, document cabinets; close all equipment such as computer upon leaving the office at the end of the working day.(2)最后離開辦公室的員工,應在離開檢查照明、空調、辦公設備是否75、關閉,并鎖好門后方能離開You must check and turn off all the lights, air-con and other work equipment, and lock the main door when you leave the premises.(3)文件要及時歸檔,機密文件要妥善保管,廢棄時必須用碎紙機消毀。 Documents must filed in time, confidential documents must be kept secure and disposed of by the cutting machine .(4 ) 工作時間員工不76、得擅離崗位,未經同意不得隨意翻閱他人文件。Absence without permission in the working hour is prohibited, Thumbing others document without approval is prohibited.內部文件,請小心使用保管,離職時交回人力資源部Please keep this internal handbook carefully.
